1. Acceptance of Terms

By accessing or using the Hearo website and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Hearo.

2. Service Description and Limitations

Hearo provides a web application that helps users discover their “HearingType” — one of 16 hearing personality types — through various assessment methods, including AI-powered audiogram image analysis, manual audiogram entry, and a personality-style quiz. The Service generates shareable hearing profiles with personalized information based on these assessments.

It is NOT a medical device, does NOT provide medical advice, diagnosis, or treatment, and should NOT be used as a substitute for professional medical or audiological evaluation. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the Service, including AI-generated insights. 3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Hearo. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. User Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate, current, and complete information during registration and to keep such information up to date.
  • You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.
  • You agree not to upload content that is illegal, infringes on intellectual property rights, or is harmful, threatening, or abusive.
  • You acknowledge and agree that Hearo does not provide medical advice, and you will consult with a qualified healthcare professional for any medical concerns or before making any health-related decisions.

5. Intellectual Property

All content, features, and functionality on Hearo — including text, graphics, logos, software, the “HearingType” methodology, and the 16 hearing personality type system — are the exclusive property of Hearo and its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain all ownership rights to the content you submit, upload, or display through Hearo, including audiogram images and quiz responses (“User Content”). By submitting User Content, you grant Hearo a worldwide, non-exclusive, royalty-free license to use, reproduce, and process the User Content in connection with providing and improving the Service, including for AI analysis features and for developing aggregated and anonymized insights.

6. AI-Powered Features

Hearo uses artificial intelligence (Google Gemini) to analyze uploaded audiogram images and generate HearingType classifications. You acknowledge that:

  • AI analysis is for informational purposes only and is not a clinical interpretation of your audiogram.
  • The accuracy of AI analysis may vary depending on image quality and other factors.
  • AI-generated outputs do not constitute medical diagnoses, treatment recommendations, or clinical advice.
  • You are solely responsible for verifying any AI-derived information with a qualified healthcare professional.
  • Uploaded images may be processed by third-party AI services (Google Gemini API) in accordance with our Privacy Policy.

7. Limitation of Liability

Please read this section carefully as it limits our liability to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEARO, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE;
  • ANY CONTENT OBTAINED FROM THE SERVICE;
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
  • ANY HEALTH-RELATED DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED THROUGH THE SERVICE.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT HEARO IS NOT RESPONSIBLE FOR ANY HEALTH-RELATED DECISIONS YOU MAKE BASED ON THE INFORMATION PROVIDED THROUGH THE SERVICE. YOU ARE SOLELY RESPONSIBLE FOR CONSULTING WITH QUALIFIED HEALTHCARE PROFESSIONALS REGARDING YOUR HEALTH AND ANY MEDICAL CONDITIONS. HEARO DISCLAIMS ALL LIABILITY FOR ANY ADVERSE OUTCOMES RESULTING FROM YOUR RELIANCE ON THE SERVICE FOR MEDICAL ADVICE OR DIAGNOSIS.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

8. Indemnification

You agree to defend, indemnify, and hold harmless Hearo, its affiliates, licensors, and service providers, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service, including your User Content and any use of information obtained from the Service.

9. Privacy and Data Handling

Our collection, use, and disclosure of your personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Hearo, you agree to the terms of our Privacy Policy.

Please note that Hearo processes health-related data (audiogram information, hearing assessments) and uses third-party services including Firebase (data storage), Google Gemini API (AI analysis), Sentry (error tracking), and Google Analytics (usage analytics). 10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. However, nothing in these Terms shall prevent you from benefiting from the mandatory provisions of consumer protection law in your country of residence.

For users in the European Economic Area (EEA), United Kingdom, or other jurisdictions with mandatory consumer protection laws, your statutory rights remain unaffected by these Terms.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may request deletion of your data at any time by contacting us.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before the new terms take effect (for example, by posting a notice on our website or sending you an email). By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the other provisions will remain in full force and effect.
